What they need
Job Overview
We're seeking a Commercial Manager with deep expertise in construction contracts, claimsavoidance, and commercial risk management on complex, multi-prime construction programs. This role serves as a key advisor to project leadership by identifying contractual, commercial, cost, and schedule risks before they impact project execution. The Commercial Manager serves as the Owner's commercial representative, proactively managing contractual risk, change management, commercial correspondence, claims avoidance, contractor entitlement, and multi-prime contract interfaces to protect project cost, schedule, and commercial outcomes. The successful candidate understands how contract terms, schedule performance, procurement activities, funding milestones, scope changes, and contractor interfaces interact across a program. They proactively identify emerging issues, develop mitigation strategies, administer change management processes, prepare and manage commercial correspondence, respond to contractor claims, preserve Owner contractual rights, and help prevent commercial risks from becoming project impacts.
Responsibilities
- Lead upstream and downstream change management efforts, ensuring Owner-directed changes, design evolution, funding-driven changes, contractor change requests, and scope growth are properly documented, evaluated, negotiated, and administered in accordance with contract requirements.
- Prepare, review, and issue contractual notices, commercial correspondence, res ervation of rights letters, directives, responses to contractor claims, requests for supportingdocumentation, and other communications necessary to preserve and protect Owner contractual rights.
- Maintain comprehensive commercial documentation and contractual records to support change management, claim defense, dispute resolution, and project closeout activities.
- Identify interface risks, scope gaps, responsibility overlaps, sequencing conflicts, and contractor interdependencies, and driving proactive resolution before impacts result in claims, disputes, delays, or cost overruns.
- Manage commercial and contractual matters across multiple prime contracts, with particular focus on interdependencies, interfaces, handoffs, and sequencing risks between contractors.
- Review contract performance, schedule progress, procurement activities, and project developments to identify emerging commercial risks and contractual exposures before they evolve into claims, disputes, delays, or cost impacts.
- Lead claim avoidance and dispute prevention efforts by proactively identifying contractual and commercial issues, issuing formal notices and correspondence, preserving contractual rights, and driving timely resolution of potential disputes before they mature into formal claims.
- Prepare, review, and administer notices, letters, change orders, claims, and commercial correspondence in accordance with contractual requirements.
- Analyze the cost and schedule implications of contractor delays, scope changes, productivity impacts, procurement challenges, and contractor performance issues to determine contractual entitlement and exposure.
- Evaluate the downstream effects of changes or delays within one contract package on other contractors and overall program performance.
- Partner with the project delivery teams to maintain a unified understanding of commercial, contractual, cost, and schedule risk.
- Advise project leadership on contract interpretation, commercial strategy, risk allocation, entitlement matters, and dispute resolution approaches.
- Monitor contractor compliance with contractual obligations, milestone commitments, and key project deliverables, escalating risks and recommending mitigation strategies.
- Support commercial negotiations, change management, claims resolution, and dispute avoidance efforts throughout the project lifecycle
- Requirements
- Bachelor's degree in Construction Management, Engineering, Business, Law, or a related discipline.
- Experience on large-scale mission-critical, data center, industrial, energy, or infrastructure projects.
- Practical working knowledge of Primavera P6 and project controls tools sufficient to independently evaluate schedule impacts and commercial risk.
- 10+ years of experience in commercial management, contracts administration, claims management, or related disciplines supporting major construction or infrastructure projects.
- Demonstrated experience administering and managing complex contract structures involving multiple contractors, suppliers, consultants, and stakeholders.
- Strong understanding of construction contracts claims management, delay analysis, change management, and dispute resolution.
- Ability to interpret and apply contract language while understanding its practical impact on project execution, cost, and schedule performance.
- Strong understanding of project management and project controls principles, including schedule logic, procurement sequencing, critical milestones, and cost forecasting.
- Proven ability to identify, assess, and mitigate commercial risks before they materialize into formal claims or disputes.
- Experience preparing contractual notices, formal correspondence, commercial assessments, entitlement analyses, and executive-level risk briefings.
- Excellent negotiation, communication, and stakeholder management skills.
